Although we would like to believe that just the odd few people decide they do not want to pay their taxes to the government, this is not the case as many businesses fall foul of tax laws as well. By not doing so, they are committing a crime under the income tax laws of the US. Each person and business has a duty to pay taxes to their government so it is able to function properly and fulfill its duty to its citizens. Despite the seriousness, crimes such as tax evasion are often referred to as ‘white collar’ owing to the type of person or company that commits them.

The term Tax Fraud covers all the crimes relating to tax that has not been paid for whatever reason, even for those who are just late in submitting their tax returns. When situations like this occur, a tax fraud lawyer is employed to help individuals and companies accused of this offence.

Do not mistake a tax fraud lawyer for someone you will contact to help file your tax returns as their sole purpose is to represent people accused of tax crimes. Often people or companies that just suspect the Internal Revenue Service is investigating their tax records will use the services of an attorney prior to any charges being levied. Imprisonment is not always necessary though and a good tax fraud lawyer will try to negotiate a settlement between the authorities and his client so that their liability is lessened.

Many tax frauds are caused due to limited or erroneous knowledge of the tax laws and are not carried out with malice of forethought. Tax advisors can also be responsible for the predicament of their clients with poor advice which create a situation where tax evasion is the result.

Often attorneys will provide proof that their client was the unwilling victim of tax fraud and although still guilty it is usual for the punishment in these circumstances to be more lenient or the charges dropped completely. The need to choose a tax consultant that has proper qualifications cannot be underestimated in circumstance like this if investigation by the IRS is too be avoided.

The most common method adopted by tax fraud lawyers to get relief for their clients is by convincing the tax authorities that prosecuting the defaulter will do more harm than good and would not fetch them the recoverable tax dues. Sending a tax evader to prison just places additional costs on the system which are paid by other tax payers with little chance of the tax owed being paid so the argument to allow the offender to pay by installments will be made by a good attorney as the best in the public interest.
